4Lindy, I'm not sure, but you can try reporting her for mail fraud through the USPS. There's also the IC3 through the FBI to track internet fraud. Maybe a British member here can help you with knowing where to report her to in the UK. Either way, she's defrauded a number of people and everyone who has been stolen from needs to report her. This is quite literally theft and it's disgusting.
I am glad to hear that she took the auctions down, but the fact remains that we now know she never sent customs to people that she claimed were lost in the mail.

Glad she took them down - if she's seen this I hope she gets in contact with 4lindy or a mod. Not that anything will excuse this beavior, but I think it needs to be rectified in some way.

I think you might have a problem claiming it as yours as it in essence, it was sent as a gift. It isn't a transaction of an item for an item or money for an item, but a gift in the assumption that she would send someone else a gift. She DOES own it. She has the right to do what she wants with it.
Yes, it isn't right and yes, it isn't fair, but all she has done is not sent customs she owes to other people. I'm not on her side, I'm just pointing out that you will find it hard to convince anyone outside of the realm of MLP that you own that item now that it is with her.

I think the only ones that'd count as mail fraud would be the one(s) she claimed she sent and didn't, or any she claimed she didn't receive...the rest were gifts, or trades. You *might* be able to claim they were stolen, since she never completed her end on some of the trades, and force her to return them, or pay you for them, but I doubt it'd happen.
As far as any trades she took part in, if her end was received, unfair as it sounds after the hard work and care everyone put into them, legally, she can sell them, as long as she doesn't claim *she* made them. :/

aww man... And to have THAT name... she needs a slap...(Im giz here) and UK... plz dont think im her.. the rat.
Gizmo was a Cat of mine, along with Sooty, so my name is always down as Giz, or Gizooty..... she shouldnt have that name... cant you change it to like.. Ratbag or somthing.. Lol..

This is so aweful! D: Things like this may result in no more swapps for anyone and all of us in the future. This makes me so angry! :'( worst is, as reddsetgogirl said..it will find it hard to convince anyone outside of the "MLP" that you own that item now that it is with her. Especially since swapps is kind of like "gifts" and "deals" at the same time.. I don't really know how that works legally. But sure is that this is a really cheap and greedy person! *cries*
And come to think of it...is there any rules about swapps in the 'Registration Agreement Terms' when you become a member on the arena? I know rules for swapps usually are agreed upon entering one. But is there anything in the Registration Agreement Terms? Should it be for the future? Just a thought, Maybe I'm just over-thinking this O__o

Hey everyone! No real updates per se....but the listings are still down, I have not heard from Gizmo, which in truth I do not expect to. And although I am furious with how this girl handled this swap, I agree that I sent my custom as a gift, and it is now her property to do with as she pleases. Even though I think she was completely dishonest in procurring customs from people and intentionally did not send out the customs she was to make. I did not report her to ebay, nor any authorities, and in truth hope no REAL trouble comes to her over my pony. I just really want people within the pony world to know of her behavior, so they can make an informed decision before dealing with her. I did send her a message through ebay telling her that now I finally know for sure that she did get my custom and gifts (and I'd suspected all along that she had gotten them), and that her complete lack of basic common courtesy has totally ruined what should have been the simple joy of giving. I don't know that she has enough conscience for that to even phase her, but I wanted to keep my language beyond reproach as I sent it through ebay. I really thank everyone for their support, I suspect that the best outcome we could have hoped for is where we are at, that she has not been able to sell and further profit from the customs that she gained in such a reprehensible manner.
