Ugh, just ugh. I swear, sellers get worse with every transaction I have! Okay, really, this is just a rant, I think I'm on top of this one, but I *had* to share:
I BIN-ed a pair of capri pants on Ebay on April 15th and sent an instant paypal payment the same day. I paid for priority shipping and the seller is only a couple states away so it shouldn't take long to get to me; after one week with no item and no communication, I sent the seller a message through Ebays messaging system just politely asking when it had been (or would be) shipped. No communication. Several days later I sent another message, this time through email directly, inquiring about my item.
Two and weeks after receiving no communication or item, I filed a dispute with paypal (that was filed on April 29th). Two days later (May 1), again after no communication whatsoever from the seller, I escalated it to a claim. Paypal said that the seller had until May 11th to respond before the claim would end (and likely be decided in my favor I would think).
So, after nearly a month of ignoring ebay messages and emails from me, and after over a week of ignoring paypals emails (regarding the dispute), the seller emailed me today, and said this:
"Have you not received your capri's yet? If not they will ship tomorrow. We are so sorry -----
$XX.XX = Total
Please send me your shipping address and payment. The following payment methods are accepted: PayPal.
Thank you again for your purchase."
I am flabbergasted. I sent my payment the day I bought the item. I have double-checked the email address I sent payment to (it should be correct because this person is a well-established seller on ebay and I used their automatic check-out system), and it seems to be correct (compared it against Ebays records, and paypal says the person is a verified business member and everything). I feel like this seller made a mistake somehow by just assuming I never sent payment? But really, if they knew I bought this item a month ago and they thought they never got payment why didn't they try to contact me? Or better yet, why didn't they respond to the messages and emails I sent them?
Ugh, I just want my money back at this point; I don't even want to deal with this seller (asking for payment a second time??). According to paypal they only have until the end of the day today to respond to the claim. The seller sent me that email a few hours ago but still hasn't responded to the paypal claim, so I'm thinking they might not respond to it at all. I am going to wait and see if the seller doesn't respond to the paypal claim and maybe paypal will decide in my favor and just give me my money back. I will respond to the seller within 36 hours, which is certainly a heck of a lot better than the communication they've given me. Again, I just hope paypal gives me my money back without any more drama.

Sounds like you got a form email back, they covered all the normal reasons why you wouldn't have your capri's yet. Hope it works out!

You'll be in the clear if they don't respond to the claim.
Just out of curiosity I'd take a look at their feedback left over the last two - three weeks and see if they've been actively on ebay. They might have had a real life issue and bailed for a couple of weeks. Not that it's acceptable to negate communication and just pick up like nothing happened, but checking the feedback left will at least give you an idea if they are incompetent or they've been off line.
I hope you get the claim decided in you favor, you've been messed around enough.
