I just won WW Cool Breeze for what I thought was a great price on ebay.The seller had emailed me immediately after the auction ended and said that the pony had been damaged and I shouldn't pay for it.I think this was just a little too suspicious and my guess is that the seller thought she went for too low and decided not to sell.
I have now emailed her and expressed my worries and asked for pics of the damaged pony but I wanted to ask you guys what is there to do if she doesn't answer or if she refuses to send the pics.If she does send them and the pony is damaged in the way she said it is,I'll just have to accept it but I do have doubts about this being the case.
Can you report to ebay a seller that cancels the trade without a reason?Or one that cannot prove they have a reason to cancel the trade?I wouldn't want to just leave a neg and let her sell the pony to someone else.I really wanted that pony and if she wanted a higher price for her,she should have set a reserve price,right?Thanks for your help!

I think there is a option where you can report a seller for backing out of the sale without a valid reason, depending on when the damage happened. Before or after the auction ended!

I checked what ebay's rules say about this and sent the direct quotation to the seller about the seller not being allowed to cancel the trade after the auction has ended.I also told her that we have an agreement and unless she can provide evidence that the pony indeed is damaged beyond repair,she has to follow that agreement.Now I'm just waiting for her response.This is so annoying...

Sounds VERY suspicious to me. If I had to put my money on it I would say she doesn't want to send it because it didn't go for enough money. What is with all these horrible Ebay sellers? Grrrr...
I would ask for pictures. Chances are she won't purposely damage the pony if she is lying. And she couldn't get crappy replacement that quickly. No pictures, she's a liar. Also, make sure if she does send you pictures those are not the pictures to someone else’s listing of a damaged Cool Breeze they are selling.

Well,she says there were only very small pieces left of the pony and she threw them away in anger.How convinient,right?
I guess there's nothing I can do,since I haven't paid for the pony and she didn't ask me to.I have no proof that she is lying so it's just my word against hers so I guess there's nothing ebay would do about it either.But I'll be sure to check her account every once in a while and if a Cool Breeze turns up for sale I'll report her without giving it a second thought.

I think I won't leave feedback at all,since I don't want to risk getting my feedback ruined in return (somehow I feel this seller will respond with a neutral/negative)...As said,I haven't paid for the pony so in that sense I'm not out of anything.I will let you -and ebay- know if the pony turns up being sold again,I'm prepared to watch for it for a while

I would report her for not following through. If you don't, she'll think she can get away with this kind of behavior with anyone. Even if they don't suspend her or anything drastic, it'll still be a pain in the butt for her.
If there's space for your explanation, tell eBay that she can't (or won't) prove to you that the pony is damaged, and wouldn't give you the opportunity to buy it even if it was broken.

I am almost positive this woman is a total liar. I would file a claim against her for being a non performing bidder. I sell on Ebay and have had things go for a lot less then I wanted them to go for, but would never dream of pulling crap like that. Very rude and dishonest.

That really irks me - if a seller has a low starting bid they have to be prepared for it to sell for that amount - sound to me like she is a liar and a rotten eBay seller.

That's absolutely retarded, and such a horrible lie. I think you need to write her back and ask her if she hacked it into pieces. Plastic does not magically fall apart.

Sounds like a big fat lie to me. You can file a non selling seller report with Ebay. It can possibly get their account suspended or at least scare them into selling you the pony. Would you mind posting their Ebay name so we know to avoid them in the future?
I wouldn't hesitate to leave a neg in a few weeks after Ebay has investigated. People should be warned about sellers like that and if she retaliates with a neg it will clearly show. I have a retalitory neg on my account and I don't regret getting it. It doesn't seem to have stopped people from dealing with me either.

I wouldnt worry about it. If she decides not to sell it to you, for whatever reason, shes still losing her ebay fees, which arnt too cheap
